Trump Shutdown Strategy Raises Legal Questions Over Federal Worker Firings

The Trump administration is moving into uncharted legal territory by using the current government shutdown to initiate widespread federal worker layoffs, a strategy that has already sparked a lawsuit from unions and democracy groups.
Shutdown as an “Opportunity”
The White House Office of Management and Budget (OMB) directed agencies to treat the shutdown as a chance to downsize the federal workforce. Press Secretary Karoline Leavitt confirmed the plan Thursday, saying the administration would target “agencies that don’t align with the administration’s values.”
While shutdowns have become a recurring feature of government, no administration has previously attempted to use them to fire furloughed workers. Legal experts say the approach raises significant questions.
Legal Pushback Emerges
The American Federation of Government Employees (AFGE), joined by several groups, filed suit claiming the plan violates the Antideficiency Act. The law bars agencies from spending money not appropriated by Congress, except in emergencies involving human life or property. Plaintiffs argue firing employees through reductions in force (RIFs) does not meet that standard.
“They’re trying to keep HR staff working during a shutdown just to fire people,” said Katie Phang of Democracy Defenders Fund. “That undermines the entire shutdown framework.”
Broader Implications
OMB defended its position, calling the lawsuit “frivolous,” while pointing to courts that have upheld broad agency discretion in layoffs. Still, critics say the move could set a precedent for weaponizing shutdowns.
The plan also aligns with Project 2025, a blueprint for reshaping government backed by OMB Director Russell Vought. Trump praised Vought’s involvement, suggesting the cuts would fulfill a long-held goal of shrinking the federal workforce.
For now, the courts will decide whether this aggressive strategy can move forward, as thousands of federal employees wait in uncertainty.
